Terms of Claim

1.) The seller is responsible for the defects that have goods when taken over by buyers. The buyer has the right to claim damages during the warranty period.

2.) In the case of a defect that can be removed, the buyer has the right to be removed free of charge, timely and properly. The seller is required to remove the defect without undue delay. Instead of removing the defect, the buyer may request the exchange of the thing, or if the defect relates only to parts of the thing, if the seller does not incur disproportionate costs in relation to the price of the goods or the seriousness of the defect. Instead of removing the defect, the seller may always replace the defective thing as perfect if the buyer does not cause serious difficulties.

3.) If there is a defect that cannot be removed and which prevents the thing from being properly used as a thing without a fault, the buyer has the right to exchange the item or has the right to withdraw from the contract. The same rights apply to the buyer if there are removable defects, but if the buyer cannot properly use the defects after repair or for more defects. In the case of other non-removable defects, the buyer is entitled to an appropriate discount on the price of the item.

4.) The consumer is entitled to apply the claim personally to the seller's store after a prior appointment by the deadline or by sending the goods packed in a packaging suitable for transport together with a copy of the defect and a copy of the purchase receipt (or warranty card, if issued):

5.) The seller is obliged to determine the manner of handling the claim immediately, in complex cases not later than within 3 working days of the filing of the complaint, in justified cases, especially if a complex technical evaluation of the condition of the product or service is required, within 30 days from the filing of the complaint. After determining how the complaint is handled, the claim will be rectified immediately, and in justified cases the complaint may be recovered later, however, the complaint may not take longer than 30 days from the date of the claim. After the deadline for complaint handling, the consumer has the right to withdraw from the contract or has the right to exchange the product for a new product.

6.) The time from claim to liability for defects until termination of the claim procedure is not counted in the warranty period. In the event of a replacement, the new warranty period begins to run from its receipt.

7.) When claiming the claim by consumer is during the first 12 months from purchase, the seller may only refute the claim by rejecting it on the basis of professional judgment. Irrespective of the outcome of professional judgment, the consumer may not be required to cover the cost of professional judgment or other costs related to professional judgment.

8.) When claiming by consumer after 12 months from purchase when the seller rejected it, the seller is obligated to indicate in the in the document of claim, to whom the consumer can send the product for expert judgment.  If the product is sent for expert judgment to the designated person, the cost of the professional judgment, as well as all other expediently related costs incurred bears the seller irrespective of the outcome of the professional judgment. If the consumer, by professional judgment, demonstrates the seller's liability for a defect, he may reapply the claim. The warranty period does not expire during the professional judgment. The seller is required to pay the consumer within 14 days of the date of the reapplication of the claim all costs incurred for professional judgment as well as all related costs incurred. The reclaimed claim cannot be denied.

9.) The seller is required to deliver the claim confirmation immediately to the consumer. If it is not possible to deliver the receipt immediately, it must be delivered without undue delay, but at the latest with the document of claim. The confirmation to claim a claim does not have to be delivered if the consumer has the ability to prove the claim in another way.
